Information for Newton, MA tobacco/nicotine permit holders
Retailers: Are you confused by all the new laws and regulations about vaping and tobacco products?
Here’s a brief timeline of what’s allowed when.

Local City of Newton health regulation restricting the sale of e-cigarettes to the two Newton adult-only stores takes effect. All other stores that have a tobacco permit (convenience stores, liquor stores, gas, grocery, market, etc.) will NOT be allowed to sell e-cigarettes. This includes tobacco and menthol flavors of e-cigarettes. Example: JUUL, PHIX, juice, pods, etc. may NOT be sold in Newton convenience stores, liquor stores, gas stations, grocery stores, markets. This is a permanent local regulation so please note that even if sales of these products are allowed elsewhere in Massachusetts, they will not be allowed in Newton.

All flavored tobacco products including mint, menthol, wintergreen, will be prohibited for sale on June 1, 2020. The new Massachusetts state legislation restricts the sale of all tobacco and vape products that have a characterizing flavor (e.g. menthol cigarettes, mint chewing tobacco and flavored vape products) to Mass. Department of Revenue-licensed Smoking Bars where they may be sold only for on-site consumption. Please note that because the City of Newton prohibits Smoking Bars (2014 regulation) these products will not be allowed to be sold anywhere in Newton (including at Newton’s two 21+ retail stores). Example: Newport cigarettes (menthol flavored) may not be sold anywhere in Newton starting June 1, 2020, but Marlboro Reds (an unflavored cigarette) may continue to be sold.

Keep in mind, some restrictions in Newton are more restrictive so local regulations and ordinances must also be followed.
