HHS Department moves forward with e-cigarette regulation

The Newton Health and Human Services Department is moving forward with its regulation to restrict e-cigarettes to adult-only retail tobacco and nicotine delivery product stores.

The legal notice will be published in the Newton Tab this week, and the regulation takes effect December 16, 2019.

At this time, no stores in Massachusetts can sell e-cigarettes due to the Governor’s emergency order. This order is currently in effect through 1/25/20. The Newton HHS regulation takes effect Dec. 16, 2019, which means once the Governor’s emergency order is lifted, e-cigarette sales will be permitted only at adult-only establishments. HHS staff carefully considered the feedback provided to the department during the comment period for this new regulation, and during the Oct. 3 public listening session.
