Purpose
The Newton Zoning Board of Appeals (ZBA) is a quasi-judicial body which interprets and enforces the City’s Zoning Ordinance. The ZBA has the power to hear and decide petitions for:
Appeals of zoning orders and decisions made by the Commissioner of the Inspectional Services Department
Variances from the requirements of the Zoning Ordinance
Comprehensive Permits under Chapter 40B of the Massachusetts General Laws

Composition
The ZBA is a five-member board, which is made up of five regular members and five associate members. The members are appointed by the Mayor and approved by the City Council to three year terms. 

Services
The ZBA holds regular meetings at 7:00 p.m. on the fourth Wednesday of each month at City Hall in the City Council Chamber located at 1000 Commonwealth Avenue, Newton Centre, unless otherwise noticed and with the exception of the months of July, August and December.  All meetings are open to the public.

Information on Dunstan East: Next Meeting - July 8, 2020

Dunstan East Project Eligibility: Mark Development, LLC has filed an application for Project Eligibility with MassHousing for a Comprehensive Permit/40B on 2.98 acres of land on Washington Street, Dunstan Street, and Kempton Place in West Newton. As proposed the project will consist of three separate buildings with a total of 243 units of rental housing and 12,521 square feet of ground floor retail space facing Washington Street. Sixty-one units will be made affordable to households earning up to 80% of area median income (AMI) and 182 units will not have any income restrictions. The Project Eligibility application is a prerequisite to filing with the Zoning Board of Appeals for a Comprehensive Permit/40B. Once the project has received a Project Eligibility letter from MassHousing the applicant will file for a Comprehensive Permit/40B with the ZBA and a public hearing will be scheduled. Information on 15 Riverdale: 

CDP Land Acquisition Company, LLC has filed an application for Project Eligibility with MassHousing for a Comprehensive Permit/40B on a site encompassing 15 Riverdale Avenue. As currently proposed, the development would consist of two separate buildings with a total of 204 units of rental housing, 4,600 square feet of retail, and 17,782 square feet of office / innovation space. Fifty-one (51) units will be made affordable to households earning 80% of the area median income (AMI), and 153 units will not have any income restrictions. The Project Eligibility application is a prerequisite to filing with the Zoning Board of Appeals for a Comprehensive Permit/40B. Once the project has received a Project Eligibility letter from MassHousing the applicant will file for a Comprehensive Permit/40B with the ZBA and a public hearing will be scheduled.
